Terms
These terms cover the free Shopper Test, the free launch audit, and the paid work I do: the Core Flows Build, the Growth and Scale plans, custom work and the fixed-price projects. They're written to be read. If something is unclear, email hello@byteroc.com and ask before you buy.
Effective October 17, 2026
1. Who you're dealing with
ByteRoc is the trading name of Moin Hossain, an independent email specialist in Dhaka, Bangladesh. "I" and "me" in these terms means Moin Hossain, trading as ByteRoc. "You" means the business that asks for a test, an audit or paid work, and the person acting for it.
2. How an engagement is agreed
When you hire me, you get a one-page agreement: the plan or project, the price, the start date and, for a monthly plan, the billing date. It's not a long-term contract. It refers to these terms, and together they are our whole agreement. If the one-page agreement and these terms ever disagree, the one-page agreement wins.
Work starts when the agreement is accepted and the first invoice is paid.
3. What's included
- Scope. Each plan and project includes what the pricing page lists for it on your start date. Anything outside that, I quote in writing first, and nothing extra is billed without your yes.
- Your approval. Nothing goes live without your approval. Every email comes to you as a draft first, with two rounds of changes included.
- Your account. Everything is built inside your own Klaviyo account. I ask for Manager access, which lets me build flows and campaigns but not export your customer list. You can remove my access at any time.
4. Fees and payment
- Prices are in US dollars, as shown on the pricing page on your start date.
- You pay by an invoice, in advance:
- the Core Flows Build and fixed-price projects before work starts;
- monthly plans at the start of each month, on the billing date.
- If an invoice is more than 7 days overdue, work pauses until it's paid. (The 14-day and holiday promises are paid in advance, so their clocks aren't affected.)
- Your own platform costs are yours, paid directly to the platform. That covers your Klaviyo plan, your Shopify plan, SMS credits (Klaviyo bills these to you) and any apps.
5. Month to month, with 30 days' notice
- Monthly plans run month to month. There's no minimum term and no exit fee.
- Either of us can end a monthly plan by email with 30 days' notice. Your last invoice covers only the days up to the end of the notice period. If you've paid for days after that, I refund them.
- The Core Flows Build and projects are one-time, so there's nothing to cancel.
- When we finish, work in progress is delivered or handed over, and everything I built stays in your account.
6. Who owns the work
- On payment, everything I make for you is yours. When an invoice is paid, I assign to you all my rights in the work it covers: flows, templates, emails, copy, designs, segments and strategy documents. This written assignment is what makes "100% yours" true.
- What stays with me. I keep my general know-how, methods and any tools or starter templates I had before working with you. You may keep using whatever of these is built into your work, for as long as you like.
- Other people's material. Fonts, stock photos, icons and apps stay under their own licenses. I tell you when something needs a license in your name.
- My portfolio. I may show finished work in my portfolio, without your private numbers, unless you ask me not to. One email is enough.
7. Confidentiality
I keep your business information private. That covers your sales, your Klaviyo data, your plans and any Shopper Test report about your store. I don't publish your results or name your business as a client without your written OK. Work and results already on this site predate these terms: the gallery, one client's unnamed result and one redacted report page. You keep my pricing proposals and reports private too, except within your own business and advisers.
8. Your customers' data
Your customers' data stays in your Klaviyo and Shopify accounts. I use it only to do the work you hired me for, and only on your instructions. I don't export your lists or keep copies, beyond what's on screen while I work. If I ever need a file to do a task, I delete it when the task is done. I keep my login details secure, and I tell you promptly if I learn of any problem affecting your data.
9. Your responsibilities as the sender
Your business is the sender of every email and text that goes out from your account. So these sit with you:
- having consent to email and text your subscribers, under CAN-SPAM for email and the TCPA and carrier rules for SMS;
- your privacy notice;
- your offers, prices and claims being accurate.
I build to good practice, including unsubscribe links, quiet hours and opt-out wording on SMS, and I flag any risk I notice. But I don't give legal advice, and your approval of each email confirms its content is right for your business.
10. My promises
These are the exact terms of the promises on this website. Business days are Monday to Friday, US Eastern time, the same definition as the site footer. "Days" without "business" are calendar days. A refund goes back to the way you paid, within 10 business days of the claim being confirmed. "Free" and "your money back" both mean a refund of what you paid.
The pays-for-itself promise
The promise. If the flows I build haven't brought in more Klaviyo-attributed revenue than the fee you'd get back within 60 days of going live, you get your money back: the $800 on a Core Flows Build, or your first month on Growth or Scale. For stores doing $30K+ a month (Core), $50K+ (Growth) or $100K+ (Scale) that keep the flows on as built.
Who it covers.
- The Core Flows Build, for stores doing $30,000 or more a month.
- The Growth plan, for stores doing $50,000 or more a month.
- The Scale plan, for stores doing $100,000 or more a month.
- Store size means average monthly sales over the three full calendar months before your start date, as shown in Shopify. It's written into your one-page agreement.
- It doesn't cover fixed-price projects or custom work.
How it's measured.
- The window is 60 days, starting on the day the first flow I built goes live (is set to "Live" in Klaviyo).
- The revenue is what your own Klaviyo flow report shows as attributed revenue for the flows I built, in that window.
- The settings are Klaviyo's attribution settings in your account as they were on your start date.
- The bar is the fee you'd get back: $800 for the Core Flows Build, or your first month's fee on Growth or Scale.
What keeps it valid.
- The flows stay on as built for the whole window. That means not paused, deleted, or edited by anyone but me, unless I agreed in writing.
- Your Klaviyo attribution settings aren't changed during the window, except by me.
- Your store stays open and taking orders, with no break longer than 7 days.
- Your Klaviyo sending isn't suspended for a reason in your control.
- Your invoices are paid.
- If I think one of these has happened, I'll tell you in writing at the time, not when you claim.
- Giving notice on Growth or Scale doesn't end the promise.
How to claim.
- Email hello@byteroc.com within 14 days after the window ends.
- Keep my Klaviyo access in place, or give me Analyst (read-only) access, so I can read the same report.
- If the flows didn't bring in more than the bar, I refund it.
Limits.
- One claim per store.
- It isn't a promise of any particular revenue.
The 14-day promise
The promise. Your three core flows are live within 14 days of your start date, or you get your money back. The clock pauses only while I'm waiting on you (a draft to approve, or a change only you can make in Shopify, your domain or Klaviyo) or during a Klaviyo or Shopify outage. Applies to the Core Flows Build and to month one of Growth and Scale.
Which flows.
- On the Core Flows Build: the welcome series, abandoned cart and post-purchase flows.
- On Growth or Scale: the three highest-earning flows we agree in writing at the start of month one.
The clock.
- Start dates. I start up to two builds a week. The 14-day clock runs from your start date. If this week's two are taken, the start date we book is the next open one. A build is a Core Flows Build, or month one of Growth or Scale.
- For this promise, your start date is the later of the start date we book and the day I have both:
- Manager access to your Klaviyo account;
- your brand basics (logo, colors and fonts, and any discount you want in the welcome series).
- It runs 14 days.
- It pauses only for any day I'm waiting on you, or during a Klaviyo or Shopify outage. Nothing else pauses it.
- a draft is waiting on your reply (from the day I send it to the day you reply);
- a change only you can make in Shopify, your domain or Klaviyo is waiting on you (from the day I ask for it in writing to the day it's done);
- Klaviyo or Shopify has an outage: each day its public status page reports an incident that affects building, testing or sending your emails. I'll tell you in writing that day, with a link to the report.
- "Live" means switched on in Klaviyo and sending to your real subscribers.
The remedy.
- On the Core Flows Build: the $800.
- On Growth or Scale: your first month's fee.
- Whatever I've built stays in your account and is yours.
How to claim. Email hello@byteroc.com within 14 days after the deadline.
Limits. One claim per store.
The holiday promise
The promise. Booked and paid by November 6, and every email is scheduled by November 24, or the pack is free. The clock pauses only while I'm waiting on you (your sale details, a draft to approve, or a change only you can make in Shopify, your domain or Klaviyo) or during a Klaviyo or Shopify outage.
What it covers. The Holiday sale pack ($1,100) for the 2026 holiday season. I take two holiday packs this year. There's no December pack and no other seasonal promise.
The details.
- "Booked and paid" means the one-page agreement is accepted and the invoice paid by 11:59 p.m. US Eastern on November 6, 2026.
- "Scheduled" means:
- all eight emails in the pack are approved and set to send in your Klaviyo account;
- the sale messaging is added to your flows;
- all of it by 11:59 p.m. US Eastern on November 24, 2026.
- Your sale details are the offer, its dates and the products to feature. Send them as soon as you book.
- The November 24 date moves one day later for each day, and only for each day:
- your sale details are waiting on you (from the day you book to the day you send them);
- a draft is waiting on your reply (from the day I send it to the day you reply);
- a change only you can make in Shopify, your domain or Klaviyo is waiting on you (from the day I ask for it in writing to the day it's done);
- Klaviyo or Shopify has an outage: each day its public status page reports an incident that affects building, testing or sending your emails. I'll tell you in writing that day, with a link to the report.
The remedy and how to claim.
- "Free" means a refund: the full $1,100 back to the way you paid. The emails stay yours.
- To claim, email hello@byteroc.com within 14 days after the deadline.
Limits. One claim per store.
How the promises fit together
- The promises don't stack. One refund per purchase; on a monthly plan, only the first month's fee.
- On any one purchase, the most you can get back under these promises is what you paid for it.
- A promise is my risk, not yours: claiming one never costs you a fee.
Other commitments on this site
- Replies. I reply within one business day. Message by 5 p.m. Eastern, and you'll have a reply by 9 a.m. Eastern the next business day.
- Shopper Test timing. The Shopper Test timing is in section 11.
- Custom quotes. Custom work gets a fixed quote in writing within 2 business days.
- Fixed-price projects. When you request one, you get a start date and an invoice within one business day.
- The agreement. The same business day you say yes to a project or plan, you get the one-page agreement.
- First drafts. Drafts within 5 business days of your start date, with two rounds of changes on every email.
The voice promise
The promise. If the sequence doesn't sound like you, I rewrite it, twice if needed. If it still doesn't, you get your money back before anything is built.
- What it covers. The Launch sequence project ($950) on /coach/.
- How it works. You get the written sequence first. If it doesn't sound like you, tell me what's off, and I rewrite it, up to two times, at no charge.
- The refund. If it still doesn't sound like you after the second rewrite, tell me before I build it into your platform. I refund the full $950, and nothing is built.
- The window. Ask for a rewrite or the refund within 14 days of receiving each version.
- Limits. One refund per project. Once you approve the sequence or I build it into your platform at your request, the refund no longer applies.
The free launch audit
The free launch audit on /coach/ is a written report within 48 hours of receiving your last launch emails, or a link to your email archive. List health and platform setup need one dashboard screenshot; without it, the report leaves those two out. No call, no card, and the report is yours to keep.
11. The free Shopper Test
What it is. For seven days I shop your store as a new customer would, as described in the privacy policy: test signups, browsing, and a checkout started and not paid. It's free.
Who can ask.
- Shopify stores only.
- One free test per store every six months.
- You must own or work for the store. By checking the box on the form ("I own or work for this store.") and sending it, you confirm that, and you ask me to run the test as this section and the privacy policy describe: to sign up, browse and leave a cart as a test shopper. If I can't confirm that, I may check with the store's published contact before starting, or decline.
What it doesn't need. No login, no call and no card. I never log in to your Shopify or Klaviyo account for the test.
When it starts.
- I start up to five Shopper Tests a week, in the order they arrive.
- If this week is full, you'll get your start date within one business day.
What you receive.
- Within 48 hours of the start, the first findings:
- whether your signup form works on phone and desktop;
- your first welcome email, and your cart email if it has fired, with timings;
- inbox, Promotions or spam, as my test inboxes on Gmail, Outlook and Yahoo saw it;
- your SPF, DKIM and DMARC.
- On day 7, the full report:
- every email sent that week, on one timeline;
- a side-by-side with the three competitors you name (if you don't name any, I pick three in your niche);
- the 14-point check, with gaps ranked;
- what to fix first and what it would take.
The welcome email redesign.
- The first four stores each month can also have their welcome email redesigned by me, in their brand.
- It's a finished phone and desktop design with the copy, yours to use.
- You say yes when your report arrives.
- If you hire me, I build it into your Klaviyo in week one.
- No case study is required.
After the test.
- I unsubscribe every test address on day 7.
- I follow up once, about three business days after the report.
- The report is yours to keep, whether you hire me or not. It stays private (section 7).
What it is and isn't.
- The report describes what my test shopper saw that week. It doesn't promise every email or setting was visible, or that fixing a gap produces a particular result.
- Where I couldn't see something, the report says so rather than guessing.
12. What I don't promise
Apart from the promises in section 10, I don't guarantee any particular revenue, open rate or result. Email results depend on things outside my control: your traffic, products, prices, stock, offers and season. "Klaviyo-attributed revenue" is Klaviyo's own measure of sales that followed an email. I use it because it's in your account and you can check it yourself.
13. Liability
- The cap. If something goes wrong, my total liability to you is limited to the fees you paid me in the 3 months before the claim. For a one-time build or project, the cap is its fee.
- What's excluded. I'm not liable for lost profits or indirect losses, or for outages and changes at Klaviyo, Shopify or other platforms.
- What isn't limited. Nothing in these terms limits liability that the law doesn't allow to be limited, or takes away rights you have by law.
14. Things outside anyone's control
Neither of us is responsible for delays caused by events outside our reasonable control: platform outages, power or internet failures, natural disasters and similar. I'll tell you promptly if one affects your work. This section doesn't change the promises in section 10: their clocks pause only as section 10 says.
15. Independence and trademarks
Klaviyo is a trademark of Klaviyo, Inc. Shopify is a trademark of Shopify Inc. ByteRoc is independent and isn't affiliated with or endorsed by either.
16. Governing law and disputes
These terms are governed by the laws of Bangladesh. If we disagree, we'll first try to sort it out by email or call within 30 days. If that fails, either of us may suggest mediation online before going to court. The courts of Dhaka have jurisdiction.
17. Notices, changes and contact
- Notices. Notices under these terms go by email: to hello@byteroc.com for me, and to the address on your one-page agreement for you.
- Changes. I may update these terms. The version in force on your start date applies to your engagement unless we both agree otherwise in writing. Each new version shows a new effective date at the top.
